vCard
Mr. Fibbe graduated from Harvard Law School and clerked for the Hon. Martin L. C. Feldman of the U.S. District Court for the Eastern District of Louisiana. He focuses his practice on complex commercial and technology litigation.
His experience includes significant intellectual property and data-protection litigation, including with an Internet focus. He represents major corporations in initiatives to protect against unauthorized online or other access, misappropriation, and use of their proprietary data by third parties, including through preventive contract protections, proactive negotiations, and aggressive litigation and arbitration to secure injunctions prohibiting "screen-scraping" of the company's website. For example, he helped try the first major cyber-trespass case in Texas. He also recently defended a major international charity in a case brought by a local affiliate challenging ownership of the organization's trademarks, which are valued in the billions of dollars.
Mr. Fibbe also handles complex commercial litigation. He participated in the trial of a case that obtained the largest actual damages verdict, judgment, and settlement in Nevada history. He handles business cases involving construction, securities, merger-and-acquisition, contract, and real estate development disputes.
Mr. Fibbe spoke at the Walter F. George School of Law, Mercer University at its symposium "The Internet: Place, Property, or Thing — All or None of the Above." His article Screen-Scraping and Harmful Cybertrespass After Intel was published in the Mercer Law Review. And he spoke at the State Bar of Texas Intellectual Property Law Advanced Course on the topic "Trademarks and the Internet."
Mr. Fibbe is a member of the State Bar of Alabama, State Bar of Texas, Houston Bar Association, and the Houston Bar Foundation. He is on the board of the Houston Lawyers Chapter of the Federalist Society, serves as the Treasurer of the R Club, and is a member of The Methodist Hospital Foundation s Young Leaders for Medicine.
He is admitted to practice in Alabama, Texas, and all United States District Courts in Texas.
